Pravidlá pre prijímanie cudzincov sa zmenia
Súčasťou úpravy je napríklad zrušenie povinnosti prikladať dôkazy o finančnom zabezpečení pobytu cudzincov.
Bratislava 5. júna (TASR) – Pravidlá pri prijímaní cudzincov na Slovensku sa zmenia. Niektoré ich administratívne povinnosti sa zrušia a niektoré úkony zjednodušia. Vyplýva to z novely zákona o pobyte cudzincov, ktorú poslanci Národnej rady (NR) SR schválili vo štvrtkovom hlasovaní.
Súčasťou úpravy je napríklad zrušenie povinnosti prikladať dôkazy o finančnom zabezpečení pobytu cudzincov. „Vždy však v súlade s európskou legislatívou. V tomto prípade ide o podmienku, ktorú je možné overiť aj po udelení či obnovení pobytu, napríklad v rámci povinností cudzincov mať počas udeleného pobytu finančné zabezpečenie pobytu na každý mesiac zostávajúceho pobytu,“ vysvetlilo ministerstvo vnútra, ktoré za novelou stojí.
Novela ruší tiež povinnosť prikladať fotografie k žiadosti o pobyt štátnych príslušníkov tretích krajín. „Na oddeleniach cudzineckej polície Policajného zboru sa totižto odoberajú biometrické údaje vrátane fotografie tváre,“ podotkol rezort. Predlžuje sa aj platnosť národných víz udeľovaných na účel získania povolenia na pobyt zo súčasných 90 na 120 dní.
Slovensko tiež bude môcť na základe zmeny zákona stanoviť kvóty na počet prijatých žiadostí o udelenie prechodného pobytu na účel podnikania. Vláda by tak mala nariadením ustanoviť maximálny počet žiadostí o udelenie prechodného pobytu, ktoré môžu prijať jednotlivé zastupiteľské úrady v kalendárnom roku. Zároveň by mohla určiť zastupiteľské úrady, ktoré nemôžu prijať žiadosti.
Ministerstvo vnútra zmeny odôvodňovalo cieľom zjednodušiť systém a odbremeniť cudzineckú polície.
Poslanci schválili tiež pozmeňujúci návrh z dielne poslancov Michala Barteka a Pauly Puškárovej (obaja Hlas-SD). Ten zavádza možnosť pre študentov z tretích krajín – absolventov tretieho stupňa vysokoškolského štúdia požiadať o zmenu účelu pobytu priamo na policajnom útvare na území SR, teda rovnako, ako to majú absolventi prvého alebo druhého stupňa vysokoškolského štúdia. Zároveň vypúšťa limitáciu získania vysokoškolského vzdelania len na území SR.
Účinnosť sa navrhuje od 1. júla tohto roka.
Rules For the Admission of Foreigners Will Change
The amendment includes, for example, the abolition of the obligation to provide evidence of financial security for the stay of foreigners.
Bratislava, June 5 (TASR) – The rules for accepting foreigners in Slovakia will change. Some of their administrative duties will be abolished and some tasks will be simplified. This follows from the amendment to the Act on the Residence of Foreigners, which was approved by deputies of the National Council (NR) of the Slovak Republic in a vote on Thursday.
The amendment includes, for example, the abolition of the obligation to provide evidence of financial security for the stay of foreigners. “However, always in accordance with European legislation. In this case, it is a condition that can be verified even after the residence has been granted or renewed, for example, as part of the obligations of foreigners to have financial security for their stay for each month of remaining residence during the granted stay,” explained the Ministry of the Interior, which is behind the amendment.
The amendment also abolishes the obligation to attach photographs to the application for residence of third-country nationals. “Biometric data, including a photograph of the face, is taken at the Foreign Police Departments of the Police Force,” the ministry noted. The validity of national visas issued for the purpose of obtaining a residence permit is also extended from the current 90 to 120 days.
Slovakia will also be able to set quotas for the number of applications for temporary residence for business purposes received on the basis of the amendment to the law. The government should thus set the maximum number of applications for temporary residence that can be accepted by individual embassies in a calendar year. At the same time, it could designate embassies that cannot accept applications.
The Ministry of the Interior justified the changes with the aim of simplifying the system and relieving the burden on the Foreign Police.
The deputies also approved an amendment from the workshop of MPs Michal Bartek and Paula Puškárová (both Hlas-SD). It introduces the possibility for students from third countries – graduates of the third degree of university studies to apply for a change in the purpose of their stay directly at the police department in the territory of the Slovak Republic, i.e. in the same way as graduates of the first or second level of higher education. At the same time, it deletes the limitation of obtaining higher education only in the territory of the Slovak Republic.
It is proposed to take effect from 1 July this year.
